Effective Date: September 23rd, 2026
Last Updated: September 23rd, 2026

1. Acceptance of Terms

By creating an account, accessing, or using the Ultimate Outfitter platform (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Platform.

2. Platform Role & Scope of Service

Ultimate Outfitter provides a software marketplace and administrative platform designed to connect independent hunting and fishing outfitters, guides, and charters ("Outfitters") with clients, hunters, and anglers ("Clients").

Administrative Intermediary Only: Ultimate Outfitter is strictly a technology software provider. We do not own, operate, manage, supervise, control, or employ Outfitters, guides, or staff, nor do we provide hunting, fishing, or outdoor guiding services.

Independent Contracting Parties: Any booking made through the Platform creates a direct contractual relationship between the Client and the Outfitter. Ultimate Outfitter is not a party to any contract or relationship established between users of the Platform.

3. Account Security & Verification Responsibilities

Users must be at least 18 years of age (or the age of legal majority in their jurisdiction) to create an account. You are responsible for maintaining the accuracy and confidentiality of your account credentials and for all activities conducted through your account.

4. Disclaimers Regarding Outfitters, Licences & Insurance

The Platform may allow Outfitters to display credentials, certifications, licences, permits, or proof of insurance. However:

No Verification Guarantee: Ultimate Outfitter does not independently verify, endorse, guarantee, or certify the validity, active status, accuracy, or legal compliance of any Outfitter credentials, licences, tags, permits, background checks, or liability insurance policies.

User Duty to Verify: Clients are solely responsible for conducting their own due diligence regarding the credentials, safety record, insurance coverage, and legal standing of any Outfitter prior to booking or participating in a trip.

Outfitter Duty to Comply: Outfitters represent and warrant that they hold all valid, active, and legally required federal, state/provincial, and local licences, permits, tags, and insurance coverage necessary to conduct guided operations.

5. Assumption of Risk & Outdoor Hazards

Guided hunting, fishing, boating, and wilderness activities involve inherent, extreme risks including, but not limited to, bodily injury, illness, permanent disability, death, adverse weather conditions, wildlife attacks, equipment failure, negligence of other participants, and remote locations with delayed access to emergency medical care.

Client Acknowledgment: Clients freely, voluntarily, and knowingly assume all risks associated with any trip, activity, or transaction arranged through or facilitated by the Platform.

Direct Waivers: Clients acknowledge that Outfitters may require additional liability waivers, hold-harmless agreements, or safety acknowledgments prior to participation.

6. Bookings, Payments, Cancellations & Refunds

Payment Processing: All payments, fees, deposits, and balances are processed through third-party payment processors. Ultimate Outfitter is not responsible for errors or delays caused by third-party payment gateways.

Outfitter Policies Apply: Deposit, cancellation, refund, and weather-delay policies are set exclusively by each individual Outfitter and disclosed on their listing or booking agreement. Ultimate Outfitter does not issue refunds for Outfitter cancellations, trip disputes, or force majeure events (e.g., severe weather, government permit cancellations).

7. Prohibited Conduct

You agree not to use the Platform to:

  1. Misrepresent your identity, age, hunting/fishing credentials, or legal eligibility.
  2. Solicit, book, or pay for trips outside the Platform to circumvent platform service fees.
  3. Upload false, misleading, defamatory, or unlawful content.
  4. Attempt to interfere with, hack, or compromise the security or operation of the Platform.

8. Limitation of Liability & Release

To the maximum extent permitted by applicable law, in no event shall Ultimate Outfitter, its parent companies, affiliates, officers, directors, employees, agents, or suppliers be liable for:

Personal Injury or Property Damage: Any personal injury, bodily damage, death, property damage, loss, or expense arising out of or related to any trip, hunt, fishing excursion, or interaction between users.

Expired or Invalid Credentials: Any losses or legal infractions arising from expired, fraudulent, or non-existent Outfitter insurance, licences, or permits.

Indirect Damages: Any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill.

Release of Liability: You hereby release and forever discharge Ultimate Outfitter and its officers, directors, employees, and agents from any and all claims, demands, causes of action, or liability arising out of or in connection with your use of the Platform or participation in any booked trip.

9. Indemnification

You agree to defend, indemnify, and hold harmless Ultimate Outfitter and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising out of or related to:

  • Your violation of these Terms.
  • Your use of or reliance on the Platform.
  • Your interactions with any other user (whether Client or Outfitter).
  • Any injury, loss, or damage occurring during a trip facilitated by the Platform.

10. Platform Availability & Modifications

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. Ultimate Outfitter reserves the right to modify, suspend, or discontinue any feature or portion of the Platform at any time without prior notice or liability.

11. Suspension & Termination

We reserve the right to suspend or terminate your account immediately, without notice or liability, if you violate these Terms, infringe upon third-party rights, or engage in conduct harmful to other users or the operational integrity of the Platform.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Alberta, Canada, without regard to its conflict-of-law principles. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the courts located within Alberta, Canada.
